The multi-touch is Apple’s intellectual property?

It seems that Apple, with its multitouch devices, such as the new Magic Mouse, iPhone, iPad, iPod Touch and all Mac laptops, infringed two patents of Taiwanese Elan Microelectronics, more specifically, the patent number 5,825 .352, and 7,274,353.
The two patents explain in detail the possibility in the devices that recognize the simultaneous use of one or more inputs to switch from keyboard to interact with your hands.
In a statement the company of chips, we read this statement:
We decided to withdraw from all over the ITC to continue to defend our patents against infringement of Apple. Proceedings of the Commission offers a fast and effective way for Elan to enforce our intellectual property.
Elan in 2008 has already won a case against this type of Synaptics, known and famous manufacturer of the touchpad to most laptops.

After the many concepts of the iPhone 4G or HD, here comes one that concerns another aspect of the iPhone. xazac87 has developed a concept of the Home screen of the new iPhone OS 4.0, due out in June.
The screen is completely redesigned and is able to quickly show calendar events, new emails, text messages, multimedia messages and missed calls (like the application of Cydia, LockInfo).
Inside the Home will also be able to move into 4 tabs, such as that of "Widgets", where we will find a kind of style Mac dashboard with clock, calendar, stock market, weather etc. …
In the section Social Instead, we manage our Twitter account and Facebook, following a simple and fast friends and their updates. Location is shown in the map with the relative positions of our friends.
It will be really revolutionary way the new Home Screen of the next generation iPhone? Knowing we do not believe Apple’s policy. Cupertino surprised by the simplicity of the iPhone and its OS. A Home Screen so "complicated" may not fit in the standard Apple.
